1. General terms & conditions

1.1 These general terms and conditions apply to all agreements between decor-hop and the customer.

1.2 By placing an order, the customer indicates and agrees to the delivery and payment conditions.

1.3 Decor-shop can adjust its delivery and payment conditions at any time in the event of changed insights. The conditions that applied at the time of the order will be observed and maintained.

1.4 These conditions apply to every agreement between decor-shop and the customer which has declared applicable to these conditions, insofar as the parties have not deviated from these conditions explicitly and in writing.

1.5 These terms and conditions also apply to agreements with the customer, for the performance of which third parties must be involved.

1.6 The offered goods and / or services are clearly and truthfully depicted and / or described and as complete as reasonably required and have the properties mentioned by decor-shop in the offer.

2. Formation of the agreement

2.1 The agreement is concluded at the time of payment of the order and compliance with the corresponding conditions.

3. Prices

3.1 As long as the agreement has not been concluded, decor-shop is authorized to change the prices stated in the web shop and the further conditions.

3.2 All prices are inclusive of VAT and exclusive of shipping costs, unless stated otherwise.

4. Delivery

4.1 Delivery by decor-shop takes place at the place of establishment of decor-shop by delivery to the carrier, which the customer has chosen. Decor-shop can in certain situations choose to deviate from the chosen carrier, if this is required due to unforeseen matters. The customer will be informed of this and any overpaid shipping costs will be refunded to the customer.

4.2 If part of the order cannot be delivered until later, the same shipping method will be used. This can be deviated from if the costs of the shipment are higher than the product to be sent. In this case, a cheaper shipping method will be used. No additional costs are associated with subsequent delivery.

4.3 If the delivery of an article for whatever reason turns out to be impossible, decor-shop will refund the amount already paid to the customer in consultation with the customer.

4.4 Despite all the care that we take with orders, it is possible that an order is not delivered or is incomplete. In that case, you can notify us up to 14 days after your order and the delivery will be supplemented or redone at our expense.

4.5.1 When products are missing in your order or when you receive an empty box / envelope, you must immediately inform decor-shop. We will investigate and you are required to cooperate and answer the questions that are asked. This is to be able to report any theft of product (s).

4.5.2 If it appears that a product has been delivered damaged and/or broken, you must inform decor-shop of this within 3 working days by e-mail. We need photos of the packaging and the product. We will work with you to find a suitable solution.

4.6 The customer is obliged to inform decor-shop of any change of address. As long as decor-shop has not received a change of address notification, you will be deemed to reside at the last address known to decor-shop and you remain liable for the items ordered by you that have been delivered to the old address. By placing an order, you authorize decor-shop to request your details - if necessary - from the municipal population administration or other authorities.

4.7 If you receive items that you have not ordered, you must inform decor-shop of this.

4.8 If an order cannot be delivered due to incorrect address details and additional costs must be incurred for this, these additional costs are for the customer. Decor-shop assumes that the correct delivery address has been left and is not liable for any costs arising from incorrect address details.

4.9 When the delivery of a shipment is delayed at the carrier, this is not the responsibility of decor-shop. Decor-shop will in that case make every effort to get a shipment delivered to the customer as soon as possible, but is bound by the policy of the carrier. When a shipment is delayed for more than 3 days, decor-shop can start an investigation into the missing package at the carrier. When a shipment appears to be missing, the order will be sent again at the expense of decor-shop.

5. Payment

5.1 You must pay by IDeal, Sofort banking, Mister Cash, Bancontant, PayPal or by bank transfer.

5.2 If decor-shop allows payment on account, a payment term of 14 days after the invoice date applies.

5.3 You cannot set off the payment against chargebacks. You may also not suspend payment for any reason.

5.4 Prepayment is only possible by payment by bank transfer.

5.5 If you do not pay (on time), you owe the statutory (commercial) interest and all judicial and extrajudicial collection costs with a minimum of 10. Decor-shop can then suspend fulfillment of its obligations or terminate the agreement.

5.6 If you do not complete an online payment on time, the order will be canceled by the payment provider. When the customer then pays for the order by bank transfer, decor-shop must be informed of this. In that case, the order can be processed again.

5.7 When an order is shipped to a country outside the European Union, import duties and VAT will have to be paid in the country of destination. These costs are borne by the recipient.

6. Retention of title

6.1 Delivered items remain the property of decor-shop until you have fulfilled all your (payment) obligations. This applies to all obligations for which the law permits the making of a retention of title, regardless of the delivered article for which the payment obligation arose.

6.2 Decor-shop is irrevocably authorized, as soon as the customer is in default with any obligation whatsoever, to take back the items that have remained the property of decor-shop from the customer.

7. Right of return

7.1 The customer has the right to return items delivered by decor-shop within 14 working days (the trial period) starting on the day after receipt in the original packaging, with a copy of the relevant invoice or packing slip, unless stated otherwise in view of the nature of the the product and packaging. The items returned must not be worn, used, opened or damaged. The customer must also comply with all conditions for return.

7.2 If the items are unused and have been returned on time and correctly, decor-shop will refund the amount of the placed order as soon as possible, but no later than 14 days after receipt of the items.

7.3 When a product is returned, the customer must pay the costs of the return shipment.

7.4 From the right of return are excluded: articles of which the seal has been broken. Articles that are no longer salable due to damage. Articles that, given the packaging, cannot be checked to see whether they have already been opened and / or used.

7.5 The burden of proof that the customer has made timely use of his right to return within the trial period rests with the customer. Decor-shop accepts in that respect a return memo or consignment note stamped by the carrier or signed by the carrier, proof of posting, or a similar document.

8. Liability

8.1 Decor-shop is not liable for advice it provides, printing and typing errors in the website or for information provided by suppliers or producers. Also, no liability applies for unforeseeable and reasonably non-verifiable poor quality of the products.

9. Transport risk

9.1 Decor-shop bears the risk of damage and loss of the articles during transport. After the items have been received by the customer, the risk of damage and loss is transferred to the customer,

9.2 In the event of a return, the customer bears the transport risk. After the items have been received by decor-shop, the risk of damage and loss is transferred to decor-shop.

9.3 If one or more articles are lost during transport from decor-shop to the customer, the customer undertakes to cooperate with the investigation upon first request. In case of failure to comply with this obligation, decor-shop is entitled to recover the price of the articles from the customer.

10. Disputes

10.1 Dutch law applies to all agreements between decor-shop and the customer.

10.2 In legal proceedings between decor-shop and the customer, the Dutch court has jurisdiction and, if and insofar as legal provisions do not oppose this, the court in the district where decor-shop is located is competent, unless decor-shop has jurisdiction for the judge of the customer's place of residence or place of business respectively.

11. Privacy

11.1 The personal data of the customer is stored in our customer system for a quick and trouble-free order processing. Of course we use the established legislation when using your personal data. Decor-shop can use the customer's data for (internal) marketing purposes, such as showing you interesting products. Permission is requested at all times for sending newsletters.

11.2 Decor-shop will under no circumstances pass on your data to third parties (without legal reasons, or beyond the purpose of its processing).

12. Other Terms

12.1 The content of these general terms and conditions as well as the content of all other expressions of decor-shop, whether or not on the internet, has been compiled with the greatest care. Decor-shop cannot, however, give any guarantees with regard to the nature, correctness or content of this information. Decor-shop is not liable for any errors or inaccuracies or for the consequences of using the information in question.
